How A US Energy Giant Allegedly Screwed Over Hundreds Of Farmers In Michigan (CHK)

Hundreds of farmers in Michigan sold exploration rights to an oil company that disappeared into thin air as soon as the land turned up dry.

This scenario has happened quite a few times in the history of the world. But in this report by Joshua Schneyer and Brian Grow at Reuters the shell company can be traced back to Chesapeake Energy Corp, America's second largest driller.

According to the report, in April 2009 Chesapeake created LA Land Acquisition Corp, which in turn created Northern Michigan Exploration LLC. Northern in turn hired a local land-lease company, which also hired a land-lease company to aid in dealing with land owners.

Chesapeake's CEO Aubrey McClendon also serves as director or CEO of LA Land and Northern, according to Reuters.

You may think this evidence would be enough to make Chesapeake liable for the money that Northern owes to over 800 Michigan farmers, but corporate law makes it hard to prosecute.

Chesapeake for its part claims that land bonuses were paid to some farmers and rejected when property titles didn't pass muster.

Word Boom - Addicting and Explosive: iPhone and iPad

WORD BOOM IS THE NEXT ADDICTING WORD GAME WHERE A TICKING BOMB*IS THE ENEMY AND YOUR BRAIN IS THE WEAPON. PLAY TOO SLOW AND YOU'LL EXPLODE!

In this game, you'll try to create words, but WATCH OUT because when you least expect it, a bomb could be coming your way to destroy your progress!*

Powers ups and boomer will affect your game play at every level. A power up can get you double or triple points but the boomers can speed up the bomb fuse or even flip your touches so that left is right and right is left.

Word Boom is simple to understand and may seem easy, but don't underestimate the ferocity of a badly timed boomer!

SINGLE PLAYER MODE:

You are given a set of seven letters that you must use to create words and fill up the empty word blocks in order to advance

Filling up the entire board is not required, but keep an eye on your "letters left" counter. If the counter does not reach 0 by the time your bomb goes off you will not advance.

MULTIPLAYER:

We believe in good sportsmanship. So please try to keep your sportsmanship when you HUMILIATE your friends in our Multiplayer mode.

Both players are given the same set of 7 letters and are faced against each other in a Word Boom deathmatch. Race to fill in as many shared empty word blocks as possible. The player with the most points at the end of the round is crowned the Victor.

But that's not all. Each player is given 3 Power Ups to use during the match. You can send a rocket to blow up their words or send a fog to cover their screen. So don't be surprised when time is winding down with you in the lead, and all of a sudden, your opponent steals your word in the last few seconds to win the game. That's Word Boom.

NOW STOP READING AND START PLAYING!

Go Check this out in the app store!

About Psychology

Psychology

Psychology is the science of the mind and behavior. The word "psychology" comes from the Greek word psyche meaning "breathe, spirit, soul", and the Greek word logia meaning the study of something. For a psychologist, human behavior is used as evidence (or an indication) of how the mind functions. We are unable to observe the mind directly; however, the functioning of our minds influences virtually all our actions, feelings and thoughts. That is why human behavior is used as raw data for testing psychological theories on how the mind functions.

New method for watching proteins fold

ScienceDaily (Dec. 23, 2011) ? A protein's function depends on both the chains of molecules it is made of and the way those chains are folded. And while figuring out the former is relatively easy, the latter represents a huge challenge with serious implications because many diseases are the result of misfolded proteins. Now, a team of chemists at the University of Pennsylvania has devised a way to watch proteins fold in "real-time," which could lead to a better understanding of protein folding and misfolding in general.

The research was conducted by Feng Gai, professor in the Department of Chemistry in the School of Arts and Sciences, along with graduate students Arnaldo Serrano, also of Chemistry, and Robert Culik of the Department of Biochemistry and Molecular Biophysics at Penn's Perelman School of Medicine. They collaborated with Michelle R. Bunagan of the College of New Jersey's Department of Chemistry.

Their research was published in the international edition of the journal Angewandte Chemie, where it was featured on the cover and bestowed VIP (very important paper) status.

"One of the reasons that figuring out what happens when proteins fold is difficult is that we don't have the equivalent of a high-speed camera that can capture the process, " Gai said. "If the process were slow, we could take multiple 'pictures' over time and see the mechanism at work. Unfortunately, no one has this capability; the folding occurs faster than the blink of an eye."

Gai's team uses infrared spectroscopy -- a technique that measures how much light different parts of a molecule absorbs -- to analyze proteins' structure and how this changes. In this case, the researchers looked at a model protein known as Trp-cage with an infrared laser setup.

In this experiment, Gai's team used two lasers to study structural changes as a function of time. The first laser acts as the starting gun; by heating the molecule, it causes its structure to change. The second laser acts as the camera, following the motions of the protein's constituent amino acids.

"The protein is made of different groups of atoms, and the different groups can be thought of as springs," Gai said. "Each spring has a different frequency with which it moves back and forth, which is based on the mass of the atom on either end. If the mass is bigger, the spring oscillates slower. Our 'camera' can detect the speed of that motion and we can relate it to the atoms it is made of and how that segment of the protein chain moves."

Even in a simple protein like Trp-cage, however, there are many identical bonds, and the researchers need to be able to distinguish one from another in order to see which of them are moving while the protein folds. One strategy they used to get around this problem was to employ the molecular equivalent of a tracking device.

"We use an amino acid with a carbon isotope marker," Culik said. "If it's incorporated into the protein correctly, we'll know where it is."

With a single carbon atom of the Trp-cage slightly heavier than the others, the research team can use its signature to infer the position of the other atoms as they fold. The researchers could then "tune" the frequency of their laser to match different parts of the protein, allowing them to isolate them in their analyses.

Similar isotopes could be inserted in more complicated molecules, allowing their folds to also be viewed with infrared spectroscopy.

"This technique enhances our structural resolution. It allows us to see which part is moving," Gai said. "That would allow us to see exactly how a protein is misfolding in a disease, for example."

The research was supported by the National Institutes of Health.

PFT: Cowboys expect Romo to play vs. Giants

Tom BradyAP

Eighteen games remain in the 2011 NFL season: Bears-Packers tonight, Falcons-Saints tomorrow and 16 games on New Year?s Day. Here?s a rundown of how each team still in contention can have its playoff position affected by the results of those 18 games:

Patriots: Clinch home-field advantage throughout the AFC playoffs by beating Buffalo or by having both the Ravens and Steelers lose.

Ravens: Clinch the AFC North and a first-round bye with a win or a Steelers loss. Clinch home-field advantage with a win and a Patriots loss.

Steelers: Clinch the AFC North with a win and a Ravens loss. Clinch home-field advantage with a win, a Ravens loss and a Patriots loss.

Texans: Locked into the AFC No. 3 seed. Week 17 is meaningless to Houston, and the Texans may rest many of their key players.

Broncos: Clinch the AFC West and the No. 4 seed by beating the Chiefs, or a Raiders loss.

Raiders: Clinch the AFC West and the No. 4 seed by beating the Chargers and a Broncos loss. If the Broncos win, the Raiders can still get a wild card if they win and the Bengals lose, plus either the Titans lose or the Jets win.

Bengals: Clinch a playoff spot and the No. 6 seed if they win, or if the Jets lose and either the Raiders or Broncos lose.

Jets: Get the No. 6 seed if they win and the Bengals and Titans and either the Raiders or Broncos lose.

Titans: Get the No. 6 seed if they win and the Bengals lose, plus either the Jets win and the Broncos or Raiders lose, or the Jets lose and the Broncos and Raiders both win.

Packers: Clinch home-field advantage throughout the NFC playoffs if they beat either the Bears tonight or the Lions next week, or if the 49ers lose next week.

49ers: Clinch a first-round bye with a win next week or the Saints losing either on Monday night or next week. The 49ers can still get home-field advantage throughout the playoffs if they win and the Packers lose to both the Bears and the Lions.

Saints: Clinch the NFC South if they win either of their two remaining games, and they could even clinch the NFC South if they lose both of their remaining games, if the Falcons lose in Week 17. The Saints can?t get home-field advantage throughout the NFC playoffs, but they can get a first-round bye if they win both their remaining games and the 49ers lose next week.

Cowboys/Giants: Next Sunday night?s game is essentially a playoff game: The Cowboys-Giants winner wins the NFC East and is the No. 4 seed, while the loser?s season is over. If the game ends in a tie, the Giants win the division.

Falcons: The Falcons can clinch a playoff spot tonight by the Packers beating the Bears. They need just one more win or one more Chicago loss to get to the playoffs. They could still win the NFC South, but only if they beat the Saints Monday night and win next week, plus the Saints lose next week.

Lions: Detroit is an NFC wild card. Whether they?re the No. 5 or No. 6 seed depends on the results of their own game with the Packers and the Falcons? remaining games.

Bears: Chicago can still make the playoffs, but only if they win both their remaining games and the Falcons lose both their remaining games.

Vikings' Peterson, Ponder out vs. Redskins (AP)

LANDOVER, Md. ? Minnesota Vikings running back Adrian Peterson injured his left knee, and Christian Ponder suffered a concussion on back-to-back plays Saturday against the Washington Redskins.

Peterson took a direct hit to the knee from Redskins safety DeJon Gomes on a 3-yard gain on the first offensive play of the second half.

Peterson lay on the ground for a couple of minutes and did not put any weight on his left leg as he was helped off the field. He was later taken on a cart to the Vikings locker room.

On the next play, Ponder was sacked by Adam Carriker and London Fletcher. Ponder remained in the game for one more play ? a third-down incomplete pass ? before heading to the locker room.

The Vikings said neither player would return.

Peterson had 12 carries for 38 yards when he left the game. He also had a 1-yard touchdown run in the second quarter.

Ponder had completed 8 of 13 passes for 68 yards. He was replaced by Joe Webb, who scored on a 9-yard run on the next series to give the Vikings the lead.

The Superstar Duets of 'The X Factor' Finals (omg!)

The Superstar Duets of 'The X Factor' Finals

The X Factor finalists held their own on Wednesday night, performing with some of the hottest names in music.

MORE: The X Factor Finalists Revealed!

"I couldn't think of a better way to open up this competition tonight," Paula Abdul gushed after Nicole Scherzinger's protege Josh Krajcik belted out a duet with Alanis Morissette.

Simon Cowell, in his trademark candid fashion, pointed out where he thought the number could've been improved.

MORE: Justin Bieber to Perform on X Factor Finale!

"I thought that you were a little intimidated at the beginning," said Simon, giving him an unofficial 8 out of 10.

While the audience was still swooning over Josh's outstanding effort, Chris Rene hit the stage alongside Avril Lavigne, sending up a performance that Nicole admitted felt "a little shaky at the top."

MORE: Steve Jones Not Leaving X Factor

Paula, the eternal optimist, defended the number, explaining that the spirit of the show concentrates more on the energy of the artist than being perfect note-for-note. L.A. Reid and Simon both agreed that the song, if released as a single, would be a hit.

Simon's pride and joy, Melanie Amaro, made history singing I Believe I Can Fly with the song's creator, R. Kelly, as this was the first time Kelly had ever performed the number as a duet. While L.A. and Nicole contemplated whether the song's key gave Melanie the best chance to excel, everyone agreed that Melanie put her all into the performance.

Watch The X Factor tomorrow night on FOX to find out who will win $5 million.

(AP) ? For all his problems with the economy, President Barack Obama is getting unexpected help from a Republican Party that seems incapable of capitalizing on its advantages.

Congressional Republicans' fumbling of the payroll tax extension issue is the latest example of party in-fighting and disarray that gives Democrats hope for the 2012 elections. GOP presidential contenders tried to distance themselves from the legislative mess. But they might be tarred nonetheless if swing voters decide the party is either inept at governing or too extreme.

The eventual GOP presidential nominee "will be somewhat shackled to the Republican brand," said Democratic strategist Erik Smith, even if it was Republicans in Congress who led the charge in an unpopular fight over the payroll tax. He said GOP House and Senate candidates will face even more problems.

The Wall Street Journal editorial page ? an important voice among conservatives ? berated Republican lawmakers for their handling of the payroll tax matter. Obama wanted to add another year to this year's reduction in the tax, which nearly all workers pay toward Social Security. Senate Republicans, after forcing Democrats to swallow several unrelated concessions, joined in an overwhelmingly bipartisan vote to approve only a two-month tax cut extension, with plans to revisit the issue next year.

House Republicans, who generally disliked the payroll tax cut from the start, refused to concur early this week. But House Speaker John Boehner on Thursday bowed to relentless criticism from conservative bloggers and several GOP senators and cleared a path for passing a bill Friday to renew the break for two months while congressional negotiators work on a longer-term measure.

If Congress doesn't act in the next 10 days, the payroll tax rate will return to 6.2 percent on Jan. 1, after one year at 4.2 percent. That would cost a family making $50,000 about $1,000.

Republican congressional leaders' actions "might end up re-electing the president before the 2012 campaign even begins in earnest," the Journal's editorial page said Wednesday.

Democrats point to episodes like the payroll tax fuss and say congressional Republicans are essentially controlled by tea party activists, whose tax and spending agendas are outside the political mainstream.

"Tea Party Republicans blocked a bipartisan bill to extend President Obama's payroll tax cut," the Democratic Congressional Campaign Committee said in a fundraising email Tuesday, minutes after a key House vote. House Democratic leader Nancy Pelosi told reporters, "The tea party tail is wagging the elephant."

Democratic strategists hope to remind voters of last summer's near-calamity over raising the limit on the federal debt ceiling. Then, as now, Boehner struggled to control his GOP caucus and to calculate which bills can and cannot pass. These Democrats want to paint the Republican Party as an out-of-touch institution that would rather stand for rigidly conservative principles than solve the nation's problems.

"I think the tea party-engendered dysfunction has the potential to really get the electorate's attention," said Jared Bernstein, a former Obama administration economist now with the Center on Budget and Policy Priorities. "At this point, the system is crippled by them."

All of this, of course, may be wishful thinking by Democrats. Republicans crushed them in the 2010 elections, giving the GOP control of the House and many governorships. Unemployment and other economic indicators bode badly for Obama's re-election hopes, and the payroll tax dust-up may seem a musty memory by next November.

One other worry looms. Americans' taxes still might rise by billions of dollars in 2012 if a deal can't be struck on a longer, one-year extension. Economists say that would depress spending and slow job growth, at least somewhat. Even if more voters blame Republicans than Democrats, Obama could end up as a net loser politically, given that the economic climate already is deeply troublesome for him.

GOP leaders say income tax cuts do more to stimulate economic growth than payroll tax reductions but worry about independents thinking it was Republicans who sought to raise their payroll taxes. At the same time, they know that hard-core conservative voters who have a bigger voice in GOP primaries might blame them for a tax cut they dislike.

Republicans may yet claim one political victory out of the payroll tax imbroglio, assuming the two-month extension goes through. In House-Senate negotiations they forced Obama to agree to an expedited decision on a proposed transcontinental oil pipeline opposed by environmental groups as part of the two-month extension.

The GOP still has a perception problem, though. Americans hold Congress in extremely low regard, but they put more blame on Republicans than Democrats.

A recent poll by the Pew Research Center found that a record-high 50 percent of Americans say the current Congress is less effective than most. By nearly 2-to-1, "more blame Republican leaders than Democratic leaders for this," Pew found. "By wide margins, the GOP is seen as the party that is more extreme in its positions, less willing to work with the other side to get things done, and less honest and ethical in the way it governs. And for the first time in over two years, the Democratic Party has gained the edge as the party better able to manage the federal government."

Galaxy Tab 10.1 vs Asus Eee Pad Transformer: Android Tablet War

Tablet computers make great gifts, and the Galaxy Tab 10.1 and Asus Eee Pad Tranformer Prime are two of the best. Both have been out for over six months now, so they can be found for around $400. Not a bad price for a 10-inch device. Both have front and rear-facing cameras, good resolution and run the Android system. Samsung has already confirmed they will be updating their Galaxy line of devices in the coming weeks. Asus has said on their Web site the Eee Pad Transformer should get the update, but it will be up to Google as to when that happens. It could be a couple more months.

The $400 price mentioned above is for the 16 gigabyte version of both devices, but they each come in a 32 gigabyte version and there's even a 64 gigabyte variant of the Galaxy Tab. Galaxy Tab is a bit ligher than the Eee Pad, thinner and has more rounded corners rather than squared off. It doesn't have a mini HDMI port, microSD card reader or companion dock that turns the tablet into a notebook computer. There are keyboard accessories that connect to the Galaxy Tab, but the Eee Pad dock adds more than just keys. For an extra $150, it adds twice the battery life, a trackpad, two full-size USB ports and full-size SD card reader. It adds quite a bit (and lends to the Transformer name), and people seem to really like it because it won Stuff Magazine's gadget of the year for 2011. It's even got a sequel. The Transformer Prime should debut in the next couple of weeks.

This is a close fight, because they devices are very similar, right down to the plastic bodies. Once you get to the store and start playing with them, you'll likely find one you like better without even looking at which is faster or lighter, but you can use this as a guide. The tablet war is a tie because the Transformer might be a slightly better device, but the Galaxy Tab will get the Android 4.0 update much sooner. Tell us in the comments what you look for in a tablet.

McQueary, speaking for the first time in public about the 2002 encounter in a Penn State locker room, said he believes that Jerry Sandusky was attacking a child with his hands around the boy's waist but said he wasn't 100 percent sure it was intercourse. (AP Photo/Bradley C Bower)

(AP) ? A graduate student waited a day after allegedly seeing a child being sexually assaulted on Penn State's campus before telling his supervisor, football coach Joe Paterno.

Paterno waited another day before calling the university's athletic director, who looped in a school vice president.

"It was a Saturday morning and I didn't want to interfere with their weekends," Paterno told a grand jury this year, recalling the unusual visit from graduate assistant Mike McQueary.

McQueary said he had seen former defensive coordinator Jerry Sandusky doing something "extremely sexual" with a young boy in a locker room shower.

On Friday, McQueary testified at a preliminary hearing for two Penn State officials ? athletic director Tim Curley and vice president Gary Schultz ? accused of covering up the story. He offered the most detailed public account yet of the child sex abuse allegations that have upended the university's football program and the entire central Pennsylvania campus.

Curley and Schultz are headed to trial on perjury charges after Friday's preliminary hearing, accused of lying to a grand jury about what McQueary told them.

Curly and Schultz waited another 10 days before meeting with McQueary to get more facts. Instead of calling police, they talked to two people: Sandusky and the executive director of his children's charity.

"I think it's a sad, sad, sad day, when you think about all of these victims, and you saw the inaction by a number of supposedly important, responsible adults. And there's a lot of inaction in this case," Marc Costanzo, a senior deputy attorney general, said after the preliminary hearing.

Besides the perjury charges, and the dozens of sex assault charges pending against Sandusky, Paterno and university president Graham Spanier have lost their jobs over the scandal.

Defense lawyers argued that McQueary "minimized" the alleged sexual assault when he talked to Paterno, ultimately leading their clients to believe that Sandusky's behavior was "inappropriate," but not criminal.

They say McQueary never relayed the seriousness of what he saw, leading them to think Sandusky was merely "horsing around."

"I didn't see any reason because I didn't think at the time it was a crime," Curley told the grand jury, according to testimony read into the record on Friday.

Curley, Schultz and Paterno have been criticized for not telling law enforcement about the 2002 charges. Prosecutors say Sandusky continued to abuse boys for six more years.

In about two hours on the witness stand, McQueary said again and again that what he saw was a sexual act, although he stopped short of saying he was sure that Sandusky, now 67, had raped the boy.

"I believe Jerry was sexually molesting him and having some type of sexual intercourse with him," McQueary said on Friday. He said later he "can't say 100 percent" that Sandusky and the boy were having intercourse because he was seeing Sandusky from behind.

He said after talking to his father, he went over to Paterno's home the next morning and said that what he had seen "was way over the lines, it was extremely sexual in nature." He said he would not have used words like sodomy or intercourse with Paterno, out of respect for the coach.

Paterno told the grand jury that McQueary said he saw Sandusky doing something of a "sexual nature" with the youngster but that he didn't press for details.

"I didn't push Mike ... because he was very upset," Paterno said. "I knew Mike was upset, and I knew some kind of inappropriate action was being taken by Jerry Sandusky with a youngster."

Paterno told McQueary he would talk to others about what he'd reported.

McQueary said he met about 10 days later with Curley and Schultz and told them he'd seen Sandusky and a boy, both naked, in the shower after hearing skin-on-skin slapping sounds.

"I would have described that it was extremely sexual and I thought that some kind of intercourse was going on," said McQueary.

McQueary said he was left with the impression both men took his report seriously. When asked why he didn't go to police, he referenced Schultz's position as a vice president at the university who had overseen the campus police

"I thought I was talking to the head of the police, to be frank with you," he said. "In my mind it was like speaking to a (district attorney). It was someone who police reported to and would know what to do with it."

The square-jawed, red-haired assistant coach spoke in a steady voice in his first public account of the alleged abuse, sometimes turning his seat and leaning in toward defense lawyers to answer questions. His voice rose a few times and he blushed once when describing the sexual encounter in the shower.

Defense lawyers for Curley and Schultz argued that a perjury charge in Pennsylvania cannot be based solely on one person's oath versus another's. The defense said uncorroborated testimony from McQueary is not enough, and sought to pick apart the ways he described the shower scene differently to different people.

The defense noted that McQueary admitted changing his description of the shower encounter when speaking with Paterno.

McQueary said he had stopped by a campus football locker room to drop off a pair of sneakers the Friday night before spring break, a quiet night on campus, when he saw Sandusky with a boy who looked to be 10 or 12 years old.

McQueary, 37, said he has never described what he saw as anal rape or anal intercourse and couldn't see Sandusky's genitals, but that "it was very clear that it looked like there was intercourse going on."

In its report last month, the grand jury summarized McQueary's testimony as saying he "saw a naked boy ... with his hands up against the wall, being subjected to anal intercourse by a naked Sandusky."

McQueary said he peeked into the shower three times ? the first via a mirror, the other two times directly. The last time he looked in, Sandusky and the boy had separated, he said. He said he didn't say anything, but "I know they saw me. They looked directly in my eye, both of them."

McQueary said the entire encounter ? from when he first entered the locker room to when he retreated to his office ? lasted about 45 seconds.

Curley told the grand jury that he couldn't recall his specific conversation with McQueary, but said McQueary never reported seeing anal intercourse or other sexual conduct. He said he spoke to Sandusky about it, who first denied having been in the shower with a boy, but later changed his story.

Schultz said he remembered McQueary and Paterno describing what the younger coach saw only in a very general way.

"I had the impression it was inappropriate," Schultz told the grand jury. "I had the feeling it was some king of wrestling activity and maybe Jerry might have grabbed a young boy's genitals."

Under cross-examination, McQueary said he considered what he saw a crime but didn't call police because "it was delicate in nature."

"I tried to use my best judgment," he said. "I was sure the act was over." He said he never tried to find the boy.

Paterno, Schultz and Curley didn't testify, but their entire grand jury testimony from January was read at the Dauphin County hearing.

Curley's attorney, Caroline Roberto, said prosecutors "will never be able to reach their burden of proof at a trial," in part because McQueary "minimized" the alleged assault to Paterno.

Schultz's attorney, Tom Farrell, predicted his client would be acquitted.

He also took a shot at Paterno, saying, "I'm an Italian from Brooklyn, and he may not have called the police but he may have done what I would have done, which is get the boys in the car with a few baseball bats and crowbars and take it to the fellow."

Sandusky says he is innocent of 52 criminal charges stemming from what authorities say were sexual assaults over 12 years on 10 boys in his home, on Penn State property and elsewhere.

Curley, 57, was placed on leave by the university after his arrest. Schultz, 62, returned to retirement after spending about four decades at the school, most recently as senior vice president for business and finance, and treasurer.

Russia's Mars probe to plunge to Earth in January (AP)

MOSCOW ? Russia's space agency says a probe bound for a moon of Mars that instead got stuck in Earth's orbit will plummet down to Earth next month.

The agency said Friday the unmanned Phobos-Ground probe that got stranded after its Nov. 9 launch will come crashing down between Jan. 6 and Jan. 19.

It says the probe's toxic fuel will burn on its fiery re-entry, but several dozen fragments with a total weight of up to 200 kilograms (440 pounds) will fall on the Earth's surface.

It says one of the probe's gauges has a small amount of radioactive Cobalt-57, but it won't pose any threat of radioactive contamination.

The agency says that the rough area where the probe's fragments will fall could only be calculated a few days ahead of its plunge.

Market ignores Europe, rises on U.S. data (Reuters)

NEW YORK (Reuters) ? U.S. stocks rose on Thursday, as signs of strength in the economy and higher-than-expected profit at FedEx outweighed more warnings about Europe.

The U.S. equity market continued its familiar back-and-forth rotation between optimism about the U.S. economy and fears that Europe's debt crisis could spark a global recession.

Lately the fear trade has been winning, as Wall Street fell to its lowest level in two weeks on Wednesday.

But FedEx Corp (FDX.N) boosted the market's sentiment. Shares shot up 8 percent to $82.47 after the package delivery company, viewed as an economic bellwether, reported stronger-than-expected quarterly profit.

The news from FedEx, along with two strong regional manufacturing surveys and other data, was welcomed after some high-profile companies recently warned about falling profits. On Thursday, Honeywell International (HON.N) said Europe's slowing economy would take a toll on orders. Honeywell's stock rose 1.7 percent to $52.41.

Tim Ghriskey, chief investment officer of Solaris Asset Management in Bedford Hills, New York, said the question for investors is whether the U.S. economy can grow if European economies stalled.

"Can the U.S. go it totally alone? No. But the rest of the world, with the exception of Europe, we are pretty positive about. We don't think it's going to fall apart," he said.

Data showed weekly applications for unemployment insurance fell to a 3-1/2 year low, while a gauge of New York state manufacturing activity rose to its highest level since May and another measure of factory activity in the mid-Atlantic region showed a surge in new orders.

The Dow Jones industrial average (.DJI) was up 45.33 points, or 0.38 percent, at 11,868.81. The Standard & Poor's 500 Index (.SPX) was up 3.93 points, or 0.32 percent, at 1,215.75. The Nasdaq Composite Index (.IXIC) was up 1.70 points, or 0.07 percent, at 2,541.01.

Trading was volatile ahead of Friday's quadruple witching expiration when not only equity options expire, but also stock index futures, stock index options and individual stock futures.

Earlier, stocks pared some of their gains after Christine Lagarde, the head of the International Monetary Fund, said the world economic outlook is "quite gloomy" and will require action by all countries to head off an escalating crisis that carries risks of a global depression.

The market's gains were concentrated in defensive sectors such as utilities, suggesting uncertainty was causing risk-takers to put their portfolios in neutral as the week nears an end, said Chad Morganlander, portfolio manager at Stifel, Nicolaus & Co in Florham Park, New Jersey.

"Unfortunately austerity without a plan for structural changes will cap economic growth and potentially could bleed into earnings. Going into the new year, portfolio managers are squaring their books for that scenario," Morganlader said.

"There's a continued rotation into safety and stability in a global austerity environment."

Big-cap technology shares slipped, including Apple Inc (AAPL.O) off 0.3 percent to $378.94 and International Business machines (IBM.N), which fell 0.7 percent to $187.48.

Novellus Systems Inc (NVLS.O) jumped 16.3 percent to $40.37 a day after it agreed to be bought by larger rival Lam Research Corp (LRCX.O) for $3.3 billion in stock.

Michael Kors Holdings Ltd (KORS.N) shares jumped 21 percent to $24.20 in their debut on the New York Stock Exchange after the luxury goods company went public at $20 per share on Wednesday, above the expected range. The stock climbed as much as 25 percent to a session high at $25.23.

About 6.72 billion shares changed hands on the New York Stock Exchange, NYSE Amex and the Nasdaq. On the NYSE, advancers beat decliners by a ratio of 18 to 11, and on the Nasdaq, 13 shares rose for ever 10 that fell.

AP-GfK Poll: Obama re-election odds roughly 50-50 (AP)

WASHINGTON ? Entering 2012, President Barack Obama's re-election prospects are essentially a 50-50 proposition, according to a new Associated Press-GfK poll. It found that most Americans say the president deserves to be voted out of office even though they have concerns about the Republican alternatives.

Obama's overall standing in the poll suggests he could be in jeopardy of losing re-election even as the survey showed that public's outlook on the economy appears to be improving. For the first time since spring, more people said the economy got better in the past month than said it got worse. The president's approval rating on unemployment shifted upward ? from 40 percent in October to 45 percent in the latest poll ? as the jobless rate fell to 8.6 percent last month, its lowest level since March 2009.

But Obama's approval rating on his handling of the economy overall remains stagnant: Thirty-nine percent approve and 60 percent disapprove.

Heading into his re-election campaign, the president faces a conflicted public. It does not support his steering of the economy, the most dominant issue for Americans, or his overhaul of health care, one of his signature accomplishments, but it also is grappling with whether to replace him with Republican contenders Mitt Romney or Newt Gingrich.

The poll found Americans were evenly divided over whether they expect Obama to be re-elected next year.

For the first time, the poll found that a majority of adults, 52 percent, said Obama should be voted out of office while 43 percent said he deserves another term. The numbers mark a reversal since last May, when 53 percent said Obama should be re-elected while 43 percent said he didn't deserve four more years.

Obama's overall job approval stands at a new low, with 44 percent approving and 54 percent disapproving. The president's standing among independents is worse: Thirty-eight percent approve while 59 percent disapprove. Among Democrats, the president holds steady with an approval rating of 78 percent while only 12 percent of Republicans approve of the job he's doing.

"I think he's doing the best he can. The problem is the Congress won't help at all," said Rosario Navarro, a Democrat and a 44-year-old truck driver from Fresno, Calif., who voted for Obama in 2008 and intends to support him again.

Robin Dein, a 54-year-old homemaker from Villanova, Pa., who is an independent, said she supported Republican John McCain in 2008 and has not been impressed with Obama's economic policies. She intends to support Romney if he wins the GOP nomination.

Obama, she said, "spent the first part of his presidency blaming Bush for everything, not that he was innocent, and now his way of solving anything is by spending more money."

Despite the soft level of support, many are uncertain whether a Republican president would be a better choice. Asked whom they would support next November, 47 percent of adults favored Obama and 46 percent Romney, the former Massachusetts governor. Against Gingrich, the president holds a solid advantage, receiving 51 percent compared with 42 percent for the former House speaker.

The potential matchups paint a better picture for the president among independents. Obama receives 45 percent of nonaligned adults compared with 41 percent for Romney. Against Gingrich, Obama holds a wide lead among independents, with 54 percent supporting the president and 31 percent backing the former Georgia congressman.

Another piece of good news for Obama: People generally like him personally. Obama's personal favorability rating held steady at 53 percent, with 46 percent viewing him unfavorably. About three-quarters called him likable.

The economy remains a source of pessimism, though the poll suggests the first positive movement in public opinion on the economy in months. One in five said the economy improved in the last month, double the share saying so in October. Still most expect it to stay the same or get worse.

"I suppose you could make some sort of argument that it's getting better, but I'm not sure I even see that," said independent voter John Bailey, a 61-year-old education consultant from East Jordan, Mich. "I think it's bad and it's gotten worse under (Obama's) policies. At best, it's going to stay bad."

Despite the high rate of joblessness, the poll found some optimism on the economy. Although 80 percent described the economy as "poor," respondents describing it "very poor" fell from 43 percent in October to 34 percent in the latest poll, the lowest since May. Twenty percent said the economy got better in the past month while 37 percent said they expected the economy to improve next year.

Yet plenty of warning signs remain for Obama. Only 26 percent said the United States is headed in the right direction while 70 percent said the country was moving in the wrong direction.

The president won a substantial number of female voters in 2008 yet there does not appear to be a significant tilt toward Obama among women now. The poll found 44 percent of women say Obama deserves a second term, down from 51 percent in October, while 43 percent of men say the president should be re-elected.

About two-thirds of white voters without college degrees say Obama should be a one-term president, while 33 percent of those voters say he should get another four years. Among white voters with a college degree, 57 percent said Obama should be voted out of office.

The poll found unpopularity for last year's health care overhaul. About half of the respondents oppose the health care law and support for it dipped to 29 percent from 36 percent in June. Just 15 percent said the federal government should have the power to require all Americans to buy health insurance.

Even among Democrats, the health care law has tepid support. Fifty percent of Democrats supported the health care law, compared with 59 percent of Democrats last June. Only about a quarter of independents back the law.

The president has taken a more populist tone in his handling of the economy, arguing that the wealthy should pay more in taxes to help pay for the extension of a payroll tax cut that would provide about $1,000 in tax cuts to a family earning about $50,000 a year. Among those with annual household incomes of $50,000 or less, Obama's approval rating on unemployment climbed to 53 percent from 43 percent in October.

The Associated Press-GfK Poll was conducted Dec. 8-12 by GfK Roper Public Affairs and Corporate Communications. It involved landline and cellphone interviews with 1,000 adults nationwide and has a margin of sampling error of plus or minus 4 percentage points.
