US suspends embassy account on Vietnam website

WASHINGTON (AP) ? The U.S. Embassy in Hanoi has deactivated its account on a popular Vietnamese website that's full of suspected pirated music and Hollywood movies, the State Department said Wednesday

The embassy had used its social media account with ZingMe to promote American values, including respect for intellectual property rights. But its presence had raised questions about digital piracy on the site and led to a review.

State Department spokesman Mark Toner said the suspension is part of a dialogue with ZingMe's parent company, VNG, about intellectual property rights and digital piracy. He said the embassy hopes to be able to reactivate its account after "adequate progress" is made on the property rights issue.

The review was ordered after The Associated Press reported last month that the embassy's ZingMe account had raised questions about whether Washington was legitimizing a site accused of piracy.

At the time, the department said the account was created to reach out to Vietnamese youth in a restricted environment. It said the review was being conducted because "some of the contents of this website are suspect and run counter to our Internet freedom policy."

Officials familiar with the review said there had been spirited internal debate about whether the embassy should continue to use the site. Those officials said the department's human rights and public diplomacy bureaus were in favor of letting the embassy remaining on ZingMe because of the site's huge reach, particularly to Vietnamese youth. The officials said that position was countered by the department's Bureau of Economic and Business Affairs, which takes the lead on intellectual property rights issues.

The officials spoke on condition of anonymity because they were not authorized to discuss the review publicly.

The free-to-download bonanza has pushed Zing into the ranks of the world's top 550 websites, while also raising concerns about the content available on the site. Record labels, singers and industry groups say the site repeatedly has ignored requests to take down material.

Coca-Cola and Samsung pulled their advertising from the site this month because of piracy concerns following questions from the AP.

The Recording Industry Association of America, which praised the decision by Samsung and Coke to withdrawn from Zing and has labeled Zing a "notorious" pirate site, said it was neither endorsing nor criticizing the embassy's decision.

Let the fiscal cliff road show begin

President Barack Obama and Republican House Speaker John Boehner meet at the White House on November 16 to discuss??President Barack Obama is ramping up efforts to win over Americans ? and pressure Congress ? on the looming fiscal cliff, with events at the White House and on the road to argue for the expiration of Bush-era tax cuts chiefly benefiting the rich.

The response from his top Republican foes? On Tuesday morning, Republican Senate Minority Leader Mitch McConnell portrayed the president's outreach effort as an unserious distraction from negotiations with Congress. But minutes after McConnell's sharp-tongued criticism, Republican House Speaker John Boehner's office announced that his members would be countering the president's road-show with one of their own.

Obama was meeting Tuesday behind closed doors with 15 small-business owners from the retail, construction, and health care information technology sector. ?At the White House on Wednesday, the president planned to showcase Americans who would be affected if no deal can be reached to extend middle-class tax cuts. On Friday, Obama planned to travel to the Philadelphia suburb of Hatfield to make a speech at the Rodon Group manufacturing facility. Rodon is an American maker of K'NEX Brands, which include Tinkertoy, K'NEX, and Angry Bird Building Sets.

In a speech on the Senate floor, McConnell cast the White House efforts as little more than a public relations gambit.

"Rather than sitting down with lawmakers of both parties and working out an agreement, he's back out on the campaign trail, presumably with the same old talking points we're all familiar with," McConnell said. "Look: we already know the President is a very good campaigner. What we don't know is whether he has the leadership qualities necessary to lead his party to a bipartisan agreement on a big issue likes this."

But 26 minutes after a transcript of McConnell's remarks landed in reporters' in-boxes, Boehner's office made it clear that the House GOP would also be taking its sales pitch on the road.

Republican lawmakers planned to hold events with small businesses around the country warning that job creation will slow if taxes on small businesses are hiked, aides said.

Republicans have warned that Obama's push to let tax cuts expire on income over $200,000 for individuals and $250,000 for families will hit some small businesses, a sector they often credit with fueling job growth. The president characterizes the tax increase -- a centerpiece of his successful reelection campaign -- as asking wealthier Americans to pay more in order to preserve popular government programs that might otherwise face steep cuts.

"Republicans understand that we must avert the fiscal cliff and have laid out a framework to do so that is consistent with the 'balanced' approach the President says he wants," Boehners spokesman Brendan Buck said. Buck accused some Democrats of ruling out "sensible spending cuts," notably overhauls of popular entitlement programs like Medicare, the government health care plan for seniors, and Medicaid, a state-federal program that provides health care to low income Americans.

The White House and Congressional Republicans profess eagerness to avoid the fiscal cliff, an economically toxic blend of tax increases and dramatic spending cuts that will go into effect January 1 unless at deal is reached on a far-reaching deficit-cutting plan (or an agreement is reached to push back what are Congressionally enacted deadlines that lawmakers can un-enact if the president signs on).

Obama spoke to Boehner and Democratic Senate Majority Leader Harry Reid over the Thanksgiving weekend, but Republicans have complained that negotiations are at an impasse. One of the major roadblocks is the fight over whether to let tax rates on higher incomes revert to Clinton-era levels. The fiscal cliff fight could shape the direction of the nation's spending for a decade ? and it certainly amounts to Obama's first major test of post-election clout.

Judge orders tobacco companies to say they lied

WASHINGTON (AP) ? A federal judge on Tuesday ordered tobacco companies to publish corrective statements that say they lied about the dangers of smoking and that disclose smoking's health effects, including the death on average of 1,200 people a day.

U.S. District Judge Gladys Kessler previously had said she wanted the industry to pay for corrective statements in various types of advertisements. But Tuesday's ruling is the first time she's laid out what the statements will say.

Each corrective ad is to be prefaced by a statement that a federal court has concluded that the defendant tobacco companies "deliberately deceived the American public about the health effects of smoking." Among the required statements are that smoking kills more people than murder, AIDS, suicide, drugs, car crashes and alcohol combined, and that "secondhand smoke kills over 3,000 Americans a year."

The corrective statements are part of a case the government brought in 1999 under the Racketeer Influenced and Corrupt Organizations. Kessler ruled in that case in 2006 that the nation's largest cigarette makers concealed the dangers of smoking for decades, and said she wanted the industry to pay for "corrective statements" in various types of ads, both broadcast and print. The Justice Department proposed corrective statements, which Kessler used as the basis for some of the ones she ordered Tuesday.

Tobacco companies had urged Kessler to reject the government's proposed industry-financed corrective statements; the companies called them "forced public confessions." They also said the statements were designed to "shame and humiliate" them. They had argued for statements that include the health effects and addictive qualities of smoking.

Kessler wrote that all of the corrective statements are based on specific findings of fact made by the court.

"This court made a number of explicit findings that the tobacco companies perpetuated fraud and deceived the public regarding the addictiveness of cigarettes and nicotine," she said.

A spokesman for Altria Group Inc., owner of the nation's biggest tobacco company, Philip Morris USA, said the company was studying the court's decision and did not provide any further comment. A spokesman for Reynolds American Inc., parent company of No. 2 cigarette maker, R.J. Reynolds Tobacco Co., said the company was reviewing the ruling and considering its next steps.

The statements Kessler chose included five categories: adverse health effects of smoking; addictiveness of smoking and nicotine; lack of significant health benefit from smoking cigarettes marked as "low tar," ''light," etc.; manipulation of cigarette design and composition to ensure optimum nicotine delivery; and adverse health effects of exposure to secondhand smoke.

Among the statements within those categories:

"Smoking kills, on average, 1,200 Americans. Every day."

"Defendant tobacco companies intentionally designed cigarettes to make them more addictive."

"When you smoke, the nicotine actually changes the brain ? that's why quitting is so hard."

"All cigarettes cause cancer, lung disease, heart attacks and premature death ? lights, low tar, ultra lights and naturals. There is no safe cigarette."

"Secondhand smoke causes lung cancer and coronary heart disease in adults who do not smoke."

"Children exposed to secondhand smoke are at an increased risk for sudden infant death syndrome (SIDS), acute respiratory infections, ear problems, severe asthma and reduced lung function."

"There is no safe level of exposure to secondhand smoke."

Justice Department spokesman Charles Miller said the department was pleased with the order.

Matt Myers, president of the Campaign for Tobacco-Free Kids, called it an important ruling.

"The most critical part of the ruling is that it requires the tobacco companies to state clearly that the court found that they deceived the American public and that they are telling the truth now only because the court is ordering them to do so," Myers said in an interview. "This isn't the last word, but this is a vitally important step because this should resolve exactly what the tobacco companies are required to say."

In July, a federal appeals court rejected efforts by the tobacco companies to overrule Kessler's ruling requiring corrective statements. The companies had argued that a 2009 law that gave the Food and Drug Administration authority over the industry eliminated "any reasonable likelihood" that they would commit future RICO violations.

In her ruling Tuesday, Kessler ordered the tobacco companies and Justice Department to meet beginning next month to address how to implement the corrective statements, including whether they will be put in inserts with cigarette packs and on websites, TV and newspaper ads. Those discussions are to conclude by March.

Simon Corbell has announced the release of the Briggs report into workplace safety in the ACT construction industry.

?The Government commits to providing a detailed response to each recommendation of the inquiry by the end of February 2013. In the interim, I can announce today that the Government will immediately take action on the report?s findings and recommendations as follows.

?First and foremost the Government agrees to increasing the number of inspectors in the Worksafe ACT Inspectorate ( recommendations 20 and 21) to enforce work health and safety laws on worksites as part of the development of the 2013-14 ACT Budget.?

The Government has also decided to adopt the following recommendations:

? Recommendation 4 ? to establish a target of a 35% improvement in the serious injury claim rate;

? Recommendation 20 ? to increase the number of work health and safety matters for which infringement notices (on the spot fines) can be issued to both employees and employers, including sub-contractors;

? Recommendation 22 ? to appoint an Industrial Magistrates Court;

? Recommendation 23 ? to implement better coordination of ACT Planning and Land Authority building inspectors and WorkSafe inspectors in the field to target specific concerns on worksites and to link their enforcement and demerit point systems;

? Recommendation 25 and 26 ? to implement, by June 2013, the ?active certification? approach into government procurement and establish comparative assessment of contractor?s safety records when competing for government projects; and,

? Recommendation 12 ? To work with other jurisdictions to establish a national registration scheme for engineers as soon as practicable, and to require engineers engaged on ACT Government projects to demonstrate their current registration on the Professional Engineers Register wherever applicable.

Mr Corbell said he would also convene a meeting of the ACT Work Safety Council to discuss the
findings of the report and agree on steps for implementation.

NEW YORK (AP) ? From Madison Square Garden to the Garden State, the Knicks cast a shadow the Nets could never escape.

The Knicks were considered first rate and the Nets second class, even in years when the better team was in New Jersey. The Nets would watch fans in orange and blue take over their home games, believing all along things would be different when they finally got their shot at the Knicks in Brooklyn.

Well, here it comes.

The city rivals play the makeup of their postponed season opener on Monday, a matchup the Knicks insist is just another game but one that's probably much bigger to the Nets.

"I think obviously being on center stage tomorrow night, all eyes on Brooklyn, truly makes this a very special night for us because it's something that we worked for, for so long," Nets CEO Brett Yormark said Sunday. "Even though it's not opening night, it's a dramatic night. I mean, the Knicks are playing well, the Nets are playing well, Brooklyn's certainly embraced this franchise, and I think tomorrow night is hopefully the start of some really special nights between the Nets and the Knicks.

"Yeah, I'd love to win the game, but it's more than that. It's about making a statement that this franchise has arrived and we are certainly part of the conversation when people are talking about pro basketball in New York."

Yormark sought to host the Knicks for the Barclays Center opener and that's what the NBA scheduled, but the game was postponed when Superstorm Sandy halted most subway travel to Brooklyn. It becomes in some ways more intriguing now with both teams off to strong starts, the Knicks (9-3) leading the Atlantic Division by one game over the Nets (8-4).

First matchup, first place on the line. Sounds big enough for a regular-season game, just don't call it a rivalry. At least, not yet.

"I think that word's been thrown around. I think we hope that it does become that, but you know the Brooklyn Nets are apparently different than the New Jersey Nets and this is a new beginning," Knicks forward Steve Novak said. "So I think to call it a rivalry before it started is a little bit early, but I don't think there's any question it's going to be a good game."

Among the Knicks, only Carmelo Anthony, a Brooklyn native whom the Nets desperately tried to acquire to be the franchise centerpiece for their move, seemed to view the game as anything special. Jason Kidd, who led the Nets to their greatest NBA success back when they owned the Knicks but never the New York area, called it "just another game on the road."

"I've been saying consistently that a rivalry comes through playoffs and hard-fought games. It just doesn't come from a team moving and two good teams in one year. It has to go throughout history," Knicks center Tyson Chandler said. "Honestly, I don't buy too much into the whole situation, the rivalry. I don't consider it a rivalry. I don't think ? it hasn't been enough. Honestly, I feel more animosity towards the Heat and the Celtics than I do the Nets."

But the Nets, even the ones who didn't endure the many miserable years in New Jersey, know what it means to the franchise and their fans, many of them new and some of them even Knicks fans who converted.

"It should be a hostile environment for them so to speak," Nets guard Joe Johnson said. "I think it will be fun. I think everybody has been waiting for this moment and we're going to come out and protect the home court."

Games in New Jersey, where the Nets played in multiple spots for 35 years after leaving Long Island, often felt like Madison Square Garden West. Knicks fans sometimes appeared to make up two-thirds of the crowds, Knicks players trying to hide their amusement and the Nets their frustration.

The Nets think they've got a much stronger fan base now, with about 11,000 season tickets sold, and they know they'll see a good balance of fans dressed in their black Monday night.

"There's definitely going to be some Knicks fans in there, but I don't think it will be as bad as it was last year and the year before that," Nets guard Deron Williams said.

The game will be televised on TNT and Yormark said some 100 media members are expected. The Nets, 6-1 in their $1 billion arena, may have to guard against being too hyped up ? though that won't be a problem for at least one of them.

"You're talking to a person, this is my 11th year in the league. I've played the Knicks about 100 times. It's just another game to be honest with you," forward Reggie Evans said. "I think it's big for a lot of people on the outside, but we just approach the game like a regular game. If we win we're not going to be all in the middle of the court like 'Oh, oh!' We're not going to be popping no champagne."

Former Nets coach Lawrence Frank said the series always lacked the competitiveness to be a true rivalry, because the Knicks beat the Nets for so many years but then almost never did when Kidd was there from 2001-08. Now, he says, it could finally get there with both teams on a similar upward path.

"It's good for the metropolitan area when both teams are doing well, it just hasn't happened a whole lot when both teams were good at the same time. They've kind of taken turns," said Frank, now coaching Detroit. "Now that they're both highly competitive, I think it's good for the area."

Even the Knicks acknowledge the rapid rise of their rivals, Anthony saying he's watched their games and gotten goose bumps when fans chant "Brook-lyn! Brook-lyn!" They will get a good look at the Nets with the teams meeting three times over the next 3? weeks, twice in Brooklyn.

Perhaps those other ones will feel like regular games for everyone, as the Knicks say they are. For now, the first one isn't to the team that now shares their city.

"In an 82-game schedule, the way I look at it, every game's important, but there are those special games, you know what I mean?" Yormark said. "And tomorrow I think is one of those special games. It means a little bit more."

Massachusetts natural gas explosion damaged 42 buildings

SPRINGFIELD, Mass. (AP) ? Preliminary investigations show more than 40 buildings were damaged in a natural gas explosion in Massachusetts that injured 18 people, building inspectors said Saturday.

A strip club was flattened and a day care center was heavily damaged in the massive explosion Friday night in Springfield, one of New England's biggest cities.

No one was killed in the explosion.

Investigators were trying Saturday to figure out what caused the blast that could be heard for miles, left a large hole in the ground where the multistory brick building housing Scores Gentleman's Club once stood and scattered debris over several blocks.

Officials already had evacuated part of the entertainment district after responding to a gas leak and odor reported about an hour before the explosion. Gas workers venting a gas leak got indications that the building was about to explode and they ducked for cover behind a utility truck ? along with firefighters and police officers ? just before the blast, said Mark McDonald, president of the New England Gas Workers Association.

Most of the injured were in that group, and the truck that saved their lives was essentially demolished, he said.

"It really is a miracle and it's an example of our public safety officials, each and every day, putting themselves in harm's way, taking what could have been considered a very routine call of an odor of gas, but they took the proper precautions," State Fire Marshal Stephen Coan said. "And thanks to God that they did."

Officials also marveled how the 5:30 p.m. blast occurred when a day care center next door was closed. The center's building was heavily damaged.

Lt. Gov. Tim Murray and Springfield Mayor Domenic Sarno were attending a tree-lighting ceremony when the explosion occurred. Sarno said some people mistakenly thought the boom was part of the holiday event.

The explosion blew out windows in a three-block radius, leaving at least three buildings irreparably damaged and causing emergency workers to evacuate a six-story apartment building that was buckling, police said. Pieces of broken glass littered streets and sidewalks. It was unclear how many residents had been evacuated. A shelter was set up at a school, but city officials said no one stayed there overnight.

Omar Fermin, manager of the Punta Cana Restaurant two blocks from the explosion site, found the floor-to-ceiling windows blasted out when he came to check on the property Saturday morning.

"It looks like an earthquake hit," said Fermin, a native of the Dominican Republic. "I've never seen anything like it."

He said he was waiting for someone to come and assess the damage. He worried the restaurant would remain closed for weeks while the owner seeks to replace the massive custom-made windows.

Authorities cordoned off the center of the explosion Saturday as building inspectors worked to identify unsafe structures. Anxious residents gathered at the perimeter, waiting for permission to visit their buildings.

Preliminary reports show the blast damaged 42 buildings housing 115 residential units, said Thomas Walsh, spokesman for Springfield Mayor Domenic Sarno.

Three buildings were immediately condemned, and 24 others require additional inspections by structural engineers to determine whether they are safe, Walsh said.

Dogs trapped in abandoned buildings barked loudly Saturday as building inspectors fanned out across the area. One inspector said he wished he could get a ladder and permission to retrieve a dog that was barking in the upper floor of one building sealed off from residents.

Authorities are opening an animal shelter for pets affected by the explosion, Walsh said.

Coan, the fire marshal, said his office is investigating the cause of the blast and its possible origin. The state's Department of Public Utilities was also investigating.

Sheila Doiron, a spokeswoman for Columbia Gas of Massachusetts, said the company will continue to monitor for any potential leaks within several blocks of the blast site. So far, she said, the company hadn't yet found any measurable readings.

The utility will keep at least 30 workers at the scene, along with a so-called sniffing car mounted with sophisticated gadgets capable of detecting low levels of gas leaks, Walsh said.

Doiron said the company also didn't find in its records any gas odor calls to the area where the strip club was located.

Authorities also deployed police officers throughout the area to prevent looting, Walsh said.

The victims were taken to two hospitals in the city. Those injured were nine firefighters, two police officers, four Columbia Gas workers, two civilians and another city employee.

Springfield, which is 90 miles west of Boston and has about 150,000 residents, is the largest city in western Massachusetts. It's known as the home of the Basketball Hall of Fame, which is not near the blast site.

The city has been rebuilding from damage caused by a tornado in June 2011.

Wayne Davis, who lives about a block from the destroyed building, said he felt his apartment shake.

"I was laying down in bed, and I started feeling the building shaking and creaking," he said.

The Navy veteran said the boom from the explosion was louder than anything he'd ever heard, including the sound of a jet landing on an aircraft carrier.

The blast was so loud it was heard in several neighboring communities. Video from WWLP-TV showed the moment of the explosion, with smoke billowing into the air above the neighborhood.

While there are plenty of deals and discounts to be had on TVs, phones,?laptops and other tech products, camera-wise, there aren't a lot of reasons to wait in line until midnight?after Thanksgiving dinner. That's because the year's best cameras ? many of which are?rounded up here?? simply?aren't subject to fire-sale pricing. The cameras you'll most likely?find in sales circulars?are cheapies to begin with, or are?nicer but older cameras that have to move because they're just taking up space.

Sure, you can get a Nikon D3200 for $600 at Best Buy on Friday, and that's a good deal on a relatively new camera. But this is the same good deal that's been going at B&H and other retailers for a while now. Same thing?goes for the unremarkable $649.99 Black Friday?price tag on the remarkable Sony NEX-5R with kit lens.?

The camera you'll see everywhere?with the biggest price cut is the?Canon T3.?Though it'll take decent pictures, it's a year old, was downmarket to begin with, and has long since been replaced by shinier hardware.?

What about the dozen or so point-and-shoots that cost less than a steak dinner? Many of them, particularly the?off-brands, will?perform worse than your phone's camera.

Perhaps the assumption is that shoppers,?in the heat of the Black Friday or Cyber Monday?moment, won't have time to check the specs. Meanwhile, camera buffs will likely?pay more for hot devices like the Olympus?E-M5 or Sony RX100, so why offer them deep?price cuts?

But if you're a photographer ??or just shopping for one ? don't despair. Prices may not be plummeting on the best stuff, but?accessories are on sale, and camera bundles offer a new kind of value proposition. Who couldn't use an extra 16-gigabyte SD card? At under?$10 each in multiple sales they're a solid deal. And every photographer needs a couple external hard drives ? and you can get multi-terabyte ones for under $100 at Staples, Best Buy or Office Depot.

If you do decide to pick up a camera, even at fairly regular prices, keep an eye out for bundles. Sometimes in order to get around manufacturer ?pricing rules, shops sell a camera for an ordinary price but include a bunch of goodies to make up for the lack of savings.
